Riegel v. Medtronic, Inc. Part II

The U.S. Supreme Court in Riegel v. Medtronic, Inc. found that in granting premarket approval, the FDA had imposed "requirements" already on Medtronic, Inc. relating to the catheter, and that the federal requirements preempted any "requirements" that the plaintiff's state-law claims would have imposed on Medtronic.

 The decision means companies manufacturing or distributing medical devices that have obtained premarket approval from the FDA do not have as much exposure to tort liability, which may be different in every state.

 

 

Without the ability to bring common-law claims under state law, the case decision makes it more difficult to bring lawsuits against medical device manufacturers for faults in medical devices.
