There are costs to a company when there are harassment suits. The morale may be low, and the people outside may not want to apply for jobs at the company.
There are defenses for the company when the employer takes care of harassing behavior by following its policies.
When there is discrimination, it is only unlawful if based on a protected category. The protected categories may have arose because there has been a history of discrimination in the categories.
