Confidentiality of Information in Discovery

On December 19, 2007, the California Court of Appeals, Sixth Appellate District, issued a decision that allows companies to have confidence when producing discovery in litigation pursuant to protective orders.  The case, Mercury Interactive Corporation v. Kenneth Klein, et al., The Recorder, et al., HO31175, resulted in a ruling that sealed discovery attached to a complaint or other court filing does not automatically become presumptively public under California Sealed Records Rules CRC 2.550 and 2.551.  Generally, documents filed in court are considered presumptively public and cannot be sealed.  The rules apply to documents that are actually used at trial.  There was no historical support to a right of access to discovery materials exchanged between civil litigants.

 

Wilson Sonsini Goodrich & Rosati, PC worked on the case.   The case involved a shareholder derivative lawsuit filed in California Superior Court, Santa Clara County. The issue on appeal was whether the Sealed Records Rules creates a presumption of public access to any document attached to a court filing.

 

 

The Court of Appeals remanded the matter to the Superior Court. The ruling shows the importance of confidentiality orders.
