Discrimination

On December 13, 2007, Perkins Coie, LLP gave a talk on discrimination.  Hidden discrimination in compensation occurs when people are hired based on how they negotiate, or the market price.  Over time, the compensation between men and women may differ if women tend to negotiate for less. 

 

 

If a company has compensation grades, it is able to keep everyone around the same level of compensation.  If a company goes public, it should keep in mind that the executive agreements are made public so it should be sure to see to it that executives are paid around the same so that there is less issue on fairness when people begin to see how much others are being paid.

 

Sexual harassment deals with the alteration of a person’s work condition.  If a supervisor harasses, it is equivalent to a company doing it.  The employer is liable.  This is different from co-workers who harass.  The company should set a tone that takes equality seriously.  Harassment is bad for business and productivity.

 

 

A company prevents discrimination by being consistent.  For instance, warn employees that what they do with company equipment is not private.  If there is a crime, the employer may even be able to search personal items such as backpacks and purses.
