Employers should address rebuttals because if they do not, employees may file claims with government agencies or lawsuits. Even if they do not know the answer, the employers should respond and say they have received the rebuttals.
Retaliation may allow a person to win even if there is no merit on a claim brought forth such as public policy violation. Even if a person is not protected on a point of law, once he/she makes a claim, he/she can win on retaliation. For instance, a person makes a claim, and after making the claim, the person gets a poor performance review. Usually retaliation claims come up during times of review.
