On October 20, 2007, Keith Chrestionson and Alex Hernaez of Kauff McClain & McGuire, LLP presented in San Francisco, CA on leave laws.  The audience responded that their performance kept them awake.  The audience enjoyed their slides and presentation of data in chart format.

For instance, in their defining of a “child”, they pointed out that under leave laws, the child required legal custody, and must be under 18 years of age.  For an adult dependent, the eligibility for leave benefits depends on whether there is a court order such as a guardianship. 

Under leave laws, the employer can give more time off than what is required by the law.

When determining eligibility for leave benefits, the employer is to send out a medical certification form to the employee for the employee to give to a doctor.  The forms may be obtained from the California Chamber of Commerce if in California.  There are time deadlines for employer responses to employee leave notifications.
