On November 10, 2007, an attorney practicing immigration law gave a talk to human resource professionals in San Francisco.  The talk had an attentive audience who learned what was needed to complete an I-9 form on the first day of employment. 

It is necessary for the employer to complete the I-9 form on the first day of employment because the person has to show he/she has the right to work in the U.S.  If the person is not a U.S. worker, he/she needs advance work authorization from the immigration service.  For instance, a nonimmigrant Visa also known as a NIV.

An example of a NIV is the H-1B for professionals.  The person with the H-1B needs to be sponsored by an employer.  Other examples are the TN and L-1.  These petitions are done by the employers and are restrict the person to only work for the employers who file the petitions.  If the person switches employers, the new employers cannot hire the person unless the new employers submit their own petitions.
