On Tuesday, October , 2007, a federal judge in the United States District Court for the Northern District of California had a hearing where the court extended for up to ten days a temporary restraining order (TRO). The TRO temporarily prevents the government from implementing new rules relating to the Social Security mismatch letters.
The court order halted the Social Security Administration from sending notices to employers informing them of the new rules on mismatch letters. The court stated that it would rule within ten days on a preliminary injunction that would bar the new rules for an indefinite period. The indefinite period may mean that the mismatch letter rules will not be implemented until the case went to trial or a higher court overruled the decision. The court’s comments during the hearing demonstrated a likelihood to grant the injunction.
