On age discrimination, the attorney studies to see if the employee has made too much money. Sometimes employers may dismiss an employee based on too much money with the excuse that the position is better suited for a junior person. This may occur in start ups where companies prefer to hire younger people. In replacing older workers, the companies may not use the reason that they need someone to work all hours of the day. This may be considered discrimination on older workers who have families and personal lives.
On promissory fraud, people making promises in the hiring process should be sure to keep the promises. For instance, if an employer tells an employee he/she will get to stay a certain time, and then the person is dismissed with the excuse that he/she was an at will employee, there is a cause of action because the promise created a contract. Though, in some instances, malicious intent is required.
