Recently, Baker & McKenzie, LLP published “Plan Now for Managing Electronic Data and Avoid Tomorrow’s Legal Risks”.  Cynthia Jackson, a partner, located in Palo Alto, CA, was the author.

Jackson begins with an observation on the overwhelming job of managing electronic data.  There is data in email, blogs, web cams, video transfers, broadband voice services. 

Jackson discusses the ease in harassing other employees and stealing confidential information.  On harassment, Jackson writes that many email harassment cases could have been prevented if companies used proper filters.  With respect to intellectual property, Jackson cites Sonoco Products v. Johnson, 23 P. 3d 1287, on a company being awarded $7 million for trade secret misappropriation where employees conspired to use stolen electronic data.
