
In June 2007, Buchalter Nemer, over a seafood lunch, gave a free seminar on insurance coverage issues. On the topic of business interruption, the speaker advised to obtain property, not liability, coverage. Like other property coverage, including those in building and construction, the insurance purchaser should avoid coverage gaps.
The speaker, Steven Brower, spoke about panel counsel, and suggested not to accept panel counsel unless it was counsel otherwise selected. The speaker recommended that the legal department be responsible for handling insurance. This may be contrary to the practices of some companies, where finance takes the lead on purchasing insurance. If insurance and risk management were under the legal department, there may be attorney-client protection.
For the audience, the speaker gave everyone a 50 tips on insurance coverage booklet, complete with a CD of his court cases, resume, and other publications of interest.
