New California Laws

The following is not meant to be legal advice, and thorough research has not been made on the topic.  For those who want to read more on this topic, they should check out the DMV web site.

For those attorneys who commute a lot, they may be interested to know some new driving laws effective in California.  There was an email passed around that these laws were effective in 2007, but it appears that they are really effective in 2008, but who really knows so for those who really want to be on the ball with driving rules, they should do their own legal research on the topic.

First, the email stated that the carpool lane, to assist in preserving the environment, is not to be driven on when someone is not carpooling or has a carpool sticker.  The first time $1068.50 fine begins on 7/1/07, but who knows if you can really trust an email even if it is sent from one of your closest friends because that friend may be duped to think that the information in the email is authentic.  But, the email goes on, don’t think that once someone has gotten a ticket for being in the carpool lane wrongfully that they will not get a ticket again.  This makes logical sense.  The email said that the $271 posted on some highways is old. There are second time and third time fines.  After the fourth time, the person could get a suspension. Why would someone make up an email on such a topic?

 

For those who like to get ahead with incorrect lane changes, the fine will be $380. However, one cannot ever really know the correct fine unless one goes out and makes an incorrect lane change right?  This is especially applicable on a highway like 580 where people want to cross the lane on solid lines or intersections in order to move ahead of the trucks. 

The email goes further to state not to block the intersection or get a $485 fine.  Cell phone use must be hands free while driving.  Was the email writer trying to protect the public sooner because it heard that the legislation on handsfree will not be in place until 2008?  Perhaps put the phone in the bag, and even the bag in the trunk so no calls will be heard and one less distraction.
