KSR International v. Teleflex is a patent case pending before the Supreme Court. The issue involved is whether it should be more difficult to obtain a patent for a claimed invention in a patent application.
It appeared that tech companies such as Intel, Microsoft, Cisco, and GM applaud the Supreme Court’s decision. These companies feared that liberally granted patents cost them too much to defend rather than damage their patent holdings and make it more difficult to stop other companies from competing with them.
The Supreme Court decided to narrow or drop the teaching, suggestion, or motivation test. This makes it more difficult to overturn patents that were too obvious to have been granted. The Supreme Court’s decision, in some people’s opinions, seem to make it harder to get a patent, and easier to challenge an issued patent in court.
