The following is not meant to be legal advice.
On March 30, 2007, Eric J. Sinrod, a partner at Duane Morris, was in Burlingame, CA to provide training to in house attorneys.
Sinrod is the author of articles on domain names. In one article, published on June 8, 2005, in USAToday.com, he writes that domain name holders may not always obtain ownership rights to domain names with the mere registration.
If the domain names impose upon the trademark rights of others, a domain name holder may need to give up the domain names. In the article, he gave the example of French Connection. French Connection was also the subject of a follow up article on December 8, 2004 where Sinrod discussed the victory of French Connection before the World Intellectual Property Organization in an arbitration gaining transfer of the domain name www.fcuklifestyle.com. The article detailed French Connection’s contentions.
Sinrod published another article on a similar topic in USAToday.com on July 28, 2004. In that article, he discussed the trademark litigation involving Ticketmaster Corporation. He discussed the role of the World Intellectual Property Organization, and stated that rushing to court had its consequences.
