The George Alberigi v. Sonoma County, Cal. Super. Ct. case is an example of how difficult it is to predict the outcome of litigation. The jury in the trial level awarded plaintiff damages for disability discrimination under Government Code Section 12940 and Retaliation Under Government Code Section 12940(h). The damages were reduced by the judge, but the taxpayers of Sonoma county are still now funding someone who won a case for not being promoted to a position requiring him to be able to engage in face to face interviews though he is unable to interview people in person and felt he was the right candidate for a job that involved interviewing people face to face.
