Carly Fiorina is said to have hit this issue in her book on her days at Hewlett-Packard. When evaluation of employees is too polite and they are given good reviews when they really require performance improvements, they become surprised when they are suddenly terminated. They think that they are terminated without explanation. They have excellent reviews in their employment files. This is a cause of employment lawsuits.
In employment lawsuits, many differences can affect the results of litigation. One alternative to litigation is mediation. In mediation, after the case is settled at the end of the day, the parties should be sure to write down what the settlement terms were. This makes the mediation discussions fresh. This speeds the settlement agreement execution, and decreases attorney fees.
