In Alberigi v. Sonoma County, Cal. Super. Ct., No. SCV-233788, 6/20/06, it was reported that plaintiff's job was to interview applicants for state health benefits, but due to panic disorder plaintiff could not meet with people face to face. The panic attacks caused Alberigi to get tense, his muscles got ridged, he would grit his teeth, squeezing and ringing his hands. The employer accommodated him by assigning him cases that could be handled entirely by phone. Plaintiff took on this job for twenty five years.
Plaintiff then applied for a promotion and was told that due to the absence of in-person interviewing experience he was not eligible. The employer did not make accommodations for the position sought for the promotion. However, the employer told plaintiff if he were willing to undertake in person interviewing duties he would be considered for the promotion. The plaintiff left work remaining on "stress leave" continuously since 2004.
