On February 10, 2007, Alex Hernaez, a partner in the San Francisco, CA office of Kauff McClain & McGuire LLP gave a talk on the employment litigation experience.

He reviewed the filing of a lawsuit on who can be sued, where someone can be sued, and strategies on what an employer or supervisor can be sued for.  In California, the filing of a complaint costs $135.  No lawyer is required for individual claims.

After a person files a lawsuit, a court can dismiss a case if the plaintiff waited too long, or the law does not protect the individual.  For instance, the laws on age discrimination do not protect everyone for discrimination based on age.

The discovery stage is the formal exchange of written questions and answers, and may be a time, money burden. 

When a case goes to a jury, there is undefined risks associated with attorneys’ fees and the verdict.  After the trial stage, there is the possibility of appeal.  The appeal stage could take two years.
