 Barr Pharmaceuticals previously stated that it would enter the market upon FDA approval of its generic Ovcon, but Warner Chilcott projected that generic entry would erode half of its branded sales. The parties asserted that the payment was for a legitimate back-up supply arrangement in which Barr Pharmaceuticals would manufacture Ovcon for Warner Chilcott when necessary. |
