The San Francisco Administrative Code will be amended to include a new paid sick leave provision (“Chapter 12W”).


Chapter 12W contains non-discrimination/non-retaliation provisions. It is unlawful for employers in any way to interfere with or deny employees the opportunity to exercise their rights under the Chapter 12W. It is unlawful for employers to discharge, threaten to discharge, demote, suspend or in any manner discriminate against an employee for exercising rights under Chapter 12W, including using the paid leave, making a complaint of an alleged violation, cooperating in an investigation or informing any person of potential rights under Chapter 12W. An individual’s paid sick leave or time off under Chapter 12W may not be counted under an absence control policy. If an employer takes an adverse employment action within 90 days after a person has made a complaint or allegation about an alleged violation, cooperated in an investigation or prosecution, opposed any unlawful practice, policy or act prohibited by the ordinance, or informed any person of their rights under Chapter 12W, the timing will raise a rebuttable presumption that the adverse action was retaliatory.
