Sexual Harassment Defined

On October 14, 2006, Harvey Pye, Principal at CorePursuit, Inc., gave a talk in San Francisco, CA on sexual harassment.

Sexual harassment includes unwelcome sexual advances, requests for sexual favors. Sexual favoritism means favored treatment, and is a form of hostile environment sexual harassment. It includes positive actions for submission to requests for unwelcome sexual favors. It is sexual harassment because other co-workers fail to be similarly favored as the one who is favored.
The federal law on sexual harassment applies to employers who have 15 or more employees. The California state law applies to employers who have 1 or more employees.

Under the California Fair Employment and Housing Act, gender discrimination, including gender identity issues, is prohibited.

In California, violations may lead to unlimited compensatory and punitive damages. Managers, co-workers may be personally liable if they are engaged in sexual harassment.

Any person who observes someone else being harassed or observes sexual conduct and is adversely affected may claim sexual harassment. For instance, harassment by a student, vendor, contractor, volunteer, visitor.
