On September 8, 2006, the Office of Federal Contract Compliance Programs (OFCCP) issued a final rule rescinding its Equal Opportunity Survey (Survey). The Survey requested contractors to provide information on personnel activities, compensation, tenure data, and affirmative action program.

In January 2006, elimination of the Survey was proposed after a study commissioned in 2003 revealed that the Survey had misdirected enforcement resources and had not assisted in identifying federal contractors engaging in systematic discrimination.

The OFCCP said it does not need the Survey to determine the level of audit it should give a contractor. Currently, a case management system is used to review key audit data for indicators of discrimination, including identification of systemic compensation discrimination.
