
Interesting research that the attorneys at Amazon.com, Shop.com, and other retailers must have to do when drafting disclaimers for products on web sites.
For instance Amazon.com and Shop.com both sell lock picking sets. These are high margin items, and likely to be popular among consumers. However, the ordinary person may not know that there is actually a federal law prohibiting the mailing of lock picking devices except to certain specified individuals who use them for their business.
The federal law states in part: (a) Any locksmithing device is nonmailable mail, shall not be carried or delivered by mail, and shall be disposed of as the Postal Service directs, unless such device is mailed to (1) a lock manufacturer or distributor; (2) a bona fide locksmith; (3) a bona fide repossessor; or (4) a motor vehicle manufacturer or dealer.
States also have their own laws on the subject.
Because of these laws, the retailer provides disclaimers to customers such that if they do not meet the requirements of the law, they should not be ordering the products. The disclaimers allow the retailer to decrease its liability risks when selling products that are not authorized for all recipients.
