California Unemployment Insurance Code Section 1376

There appears to be a statute of limitations for unemployment insurance overpayment assessments. Who would have thought? The notices for unemployment overpayment may not clearly indicate the language of Section 1376. The honest person who likes to be clear of debts, in receiving the notice, may not know that he/she is able to appeal based on the statute of limitations, and go ahead and pay the claimed overpayment.
California Unemployment Insurance Code Section 1376 reads as follows:

The Director of Employment Development shall determine the amount of the overpayment and any assessment authorized under Section 1375.1 and shall notify the liable person of the basis of the overpayment determination. In the absence of fraud, misrepresentation, or willful nondisclosure, notice of the overpayment determination shall be mailed or personally served within the latest of the following periods:

(a) Not later than one year after the close of the benefit year in which the overpayment was made.

(b) Not later than six months after the date a backpay award was made.

The statute of limitations may give someone an argument that even if the person was liable for overpayment, the person may not have to pay back the overpayment or the penalties if the person can show that he/she received the notice of unemployment after the above timeframes.
