
Ever walk into the house ware area of a department store in California, or order glassware or ceramic products from an e-commerce site to be shipped to California, and see labels warning the user of reproductive problems and cancer?
Proposition 65, a voter-approved measure, prohibits the sale in California of glassware and ceramic goods containing certain chemicals such as lead and cadmium, unless the products include certain warnings that use may cause cancer and reproductive problems. Without proper warnings, California citizens may lack information necessary to make informed decisions on whether and how to reduce or eliminate the risk of exposure to toxic chemicals from use of the products.
The companies involved include manufacturers, distributors, and retailers, including bars, restaurants, and hotels. Targeted products include decorated tableware, beer and soda bottles, wine glasses, and coffee mugs.
Companies are subject to penalties of as much as $2,500 a day for each product found to be violating the law. Any citizen of California acting in the interest of the general public may enforce Proposition 65 through civil litigation.
