A Delaware judge made a decidedly "uncommercial" decision when he refused to enforce a contract that expressly permitted lying. Professor Larry E. Ribstein has a detailed analysis of the case, Should a court enforce a contract that permits lying?, on his Ideoblog. (Hat tip to Delaware Corporate and Commercial Litigation Blog's Enforceability of Contract that Allows Lying.)
And, have you heard about CBS's lawsuit against "shock jock" Howard Stern? CBS let's the guy promote his new Sirius gig for over a year on their radio show and now sue him because they think he's making too much money? I don't get it. Read Professor Meredith R. Miller's post, CBS Sues "Shock Jock" and Sirius For Breach of Contract, at ContractsProf Blog for her take on this.

Thanks for the hat tip.
