
Marty Schwimmer had a busy weekend over at The Trademark Blog. One of his posts, Will “Where’s the Beef?” Become Actionable Under Proposed Dilution Law?, reflects on legislation pending in Congress, specifically, H.R. 683, the Trademark Dilution Revision Act. Marty addresses concerns raised in a letter from the American Library Association, Electronic Frontier Foundation, National Video Resources, Professional Photographers of America, Public Citizen, Public Knowledge, and Society of Children’s Book Writers and Illustrators to the Senate Judiciary Committee. Challenging H.R. 683’s proposed fair use provisions as too broad, the letter suggests that Walter Mondale’s use of the slogan, “Where’s the beef,” during the 1984 primaries “’could be actionable as dilution under the bill . . .’” Marty’s not so sure about that, and suggests that the proposed legislation could have other consequences. It's a provocative post, well worth reading.
